Terms of Service

Please read these Terms of Service carefully before using qrbug.com. By using the Service, you agree to be bound by these Terms.

1. Parties and Definitions

These Terms of Service ("Terms") govern the relationship between:

  • User: Any natural or legal person who visits qrbug.com, creates an account, or uses the Service ("User", "you").

The following definitions apply throughout these Terms:

  • Service: QR code generation, management, dynamic redirect, QR menu and ordering, analytics, and all related ancillary services offered through qrbug.com.
  • Account: Your registered membership for accessing the Service.
  • Subscription: A recurring payment commitment for paid plans (Dynamic QR Lite/Pro/Teams; QR Menu Starter/Growth/Pro).
  • Content: Any data you upload, create, or share through the Service (target URLs, menu items, images, etc.).

2. Scope of the Service

QRbug is a software-as-a-service (SaaS) platform offering QR code generation, dynamic QR redirection, QR menu and order management, and scan analytics for individuals and businesses. The Service is offered in three tiers:

  1. Free Generator: Static QR generation, no signup required.
  2. Dynamic QR: Trackable QR codes with editable destinations (paid plan).
  3. QR Menu and Ordering: Menu, ordering, and payment flow for restaurants and businesses (paid plan).

QRbug reserves the right to develop, modify, or restrict the scope and features of the Service. Material changes will be announced at least 30 days in advance via email or in-app notice.

3. Accounts and Security

3.1. To access paid features, you must create an Account.

3.2. You agree to provide accurate, current, and complete information when creating your Account. We reserve the right to suspend or terminate Accounts containing false information.

3.3. Age requirement: You must be at least 16 years old to use the Service. If you are under 18, you may use the Service only with the consent of your legal guardian; for paid Subscriptions, the legal guardian is treated as a contracting party.

3.4. You are responsible for safeguarding your Account credentials (email, password, session cookies) and for all activity occurring under your Account. Notify us immediately at [email protected] upon any unauthorized use.

3.5. An Account belongs to a single natural or legal person. You may not transfer, sell, or share your Account with third parties.

4. User Obligations and Prohibited Use

You agree to comply with the following when using the Service:

4.1. Lawful conduct: You shall comply with all applicable laws of the Republic of Turkey and any international laws applicable to you.

4.2. Prohibited content / use:

  • Content that infringes copyright, trademark, or other intellectual property rights
  • Phishing, malware distribution, fraud
  • Child exploitation, terrorism, racism, or hate speech
  • Misleading third parties to harvest personal data (in violation of KVKK)
  • Any conduct constituting an offence under the Turkish Penal Code or other applicable law
  • Unauthorized access to, reverse engineering of, or scraping of the Service infrastructure
  • Use of the Service for spam, mass email, or unsolicited communication

4.3. Notice obligation: If you become aware of unlawful content or use, please report it to [email protected]. QRbug will assess such reports within 24 hours and remove the content or suspend the Account if warranted.

4.4. Consequences of breach: In the event of a breach, QRbug reserves the right to suspend the Account, remove content, and report to authorities — without prior notice if necessary.

5. Fees, Billing, and Payment

5.1. Plan structure: Current plan prices and features are listed at /pricing. Prices are displayed inclusive of VAT unless otherwise stated.

5.2. Billing cycle: Subscriptions renew monthly unless otherwise specified. Payment is collected on the same day each month from the date of subscription.

5.3. Auto-renewal: Your Subscription auto-renews unless cancelled before the end of the current billing period.

5.4. Payment processors: Payments are processed through iyzico (for Turkey-based users) and Stripe (for international users). Card details are never stored on QRbug servers; PCI-DSS compliant infrastructure is used.

5.5. Tax: For Turkey-based customers, the prevailing VAT rate is added to all charges. For non-Turkey customers, the Service is invoiced as an export and exempt from Turkish VAT (per applicable provisions of the Turkish VAT Code).

5.6. Failed payments: If a payment fails, you will be notified within 7 days and asked to update your payment method. If payment is not received within 7 days of the notice, the Subscription will be suspended.

5.7. Price changes: QRbug reserves the right to change Subscription pricing. Price changes will be communicated 30 days in advance via email and apply from the next billing period. If you do not accept the new price, you may cancel your Subscription.

6. Right of Withdrawal (Distance Sales)

6.1. Under the Turkish Consumer Protection Law No. 6502 and the Distance Sales Regulation, Users qualifying as Consumers have the right to withdraw from the contract within 14 (fourteen) days of contract formation, without giving any reason and without paying any penalty.

6.2. Exercising the right of withdrawal: Send a withdrawal request to [email protected] or use the "Cancel Subscription" flow in your Account panel.

6.3. Refund: Within 14 days of receipt of your withdrawal request, the full amount paid will be refunded using the same payment method.

6.4. Exception to withdrawal: Under the Distance Sales Regulation's exception for "services performed instantly in the electronic environment", if you have substantively used the Service within the 14-day period (e.g., created dynamic QR codes that have received scans, published a QR menu), the right of withdrawal may be forfeited. In such cases, no pro-rata refund is available for the unused portion.

6.5. Users who do not qualify as Consumers (i.e., business / corporate Subscriptions) are not entitled to the right of withdrawal; the termination provisions of Section 7 apply to them.

7. Termination and Account Closure

7.1. You may cancel your Subscription at any time, without giving any reason, via your Account panel or by emailing [email protected]. Cancellation takes effect at the end of the current billing period; no refund is provided for the unused portion (except for valid withdrawal requests under Section 6).

7.2. To fully close your Account, use the "Delete Account" flow in your Account settings. Upon Account deletion:

  • All active Subscriptions are cancelled.
  • Your QR codes, content, and data are soft-deleted.
  • You may reactivate your Account within 30 days; afterwards, data is permanently deleted.
  • Your KVKK Article 7 deletion request is fulfilled.

7.3. QRbug reserves the right to suspend or terminate your Account without prior notice in the following cases:

  • Material breach of the Terms (in particular, prohibited use under Section 4)
  • Outstanding balance unpaid for more than 90 days
  • Conduct that damages or threatens the Service infrastructure
  • Cases mandated by competent authorities

7.4. Upon termination, the data deletion procedure in Section 7.2 applies.

8. Intellectual Property Rights

8.1. QRbug-owned rights: The design, source code, "QRbug" trademark, logos, software infrastructure, and content of qrbug.com belong to Mavipiksel İnternet Çözümleri ve Bilgisayar Sistemleri Ltd. Şti. and are protected by copyright, trademark, and related law.

8.2. Licence to you: You are granted a non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. This licence does not grant access to source code, the right to copy, or the right to create derivative works.

8.3. User Content: Content you upload (menus, images, target URLs, etc.) belongs to you. You grant QRbug a limited, royalty-free, worldwide licence to host, reproduce, display to recipients, and perform necessary technical transformations of such Content — solely for the purpose of providing the Service.

8.4. Generated QR codes: The QR code images you generate belong to you and may be used for any commercial or non-commercial purpose.

9. Privacy

The processing of your personal data is governed by the Privacy Policy and KVKK Disclosure. By accepting these Terms, you confirm that you have read and understood the Privacy Policy.

10. Limitation of Liability

10.1. As-is: The Service is provided "as is" and "as available". QRbug does not warrant that the Service will be uninterrupted, error-free, or fit for a particular purpose.

10.2. Liability cap: To the maximum extent permitted by law, QRbug's total liability arising from these Terms or your use of the Service is limited to the total fees paid by the User to QRbug in the 12 months preceding the claim.

10.3. Indirect damages: QRbug shall not be liable for indirect, incidental, special, or consequential damages, including loss of data, loss of profits, business opportunity loss, or reputational harm.

10.4. Consumer rights preserved: The limitations in Sections 10.2 and 10.3 do not affect your Consumer rights under Consumer Protection Law No. 6502, the Turkish Code of Obligations No. 6098, or other mandatory provisions.

10.5. Third-party services: The Service relies on third-party providers (Stripe, iyzico, Cloudflare, etc.). QRbug is not directly liable for outages or errors of these providers.

11. Force Majeure

If the performance of obligations under these Terms is prevented by events beyond the parties' reasonable control (natural disaster, epidemic, war, government order, telecommunications outage, large-scale cyber attack, etc.), the parties shall be excused from performance during such force majeure event.

12. Changes to These Terms

12.1. QRbug reserves the right to update these Terms from time to time. Material changes will be communicated 30 days in advance via email to the address registered with your Account or via in-app notice.

12.2. Continuing to use the Service after the changes take effect constitutes acceptance of the updated Terms. If you do not accept the new Terms, you may cancel your Subscription.

13. Governing Law and Jurisdiction

13.1. These Terms are governed by the law of the Republic of Turkey.

13.2. The Courts and Enforcement Offices of İzmir, Turkey have jurisdiction over disputes arising from these Terms. For Users qualifying as Consumers, the jurisdiction of the Consumer Arbitration Boards and Consumer Courts under Consumer Protection Law No. 6502 is preserved.

13.3. Consumer disputes: Users qualifying as Consumers may apply to Consumer Arbitration Boards or Consumer Courts based on the monetary thresholds annually determined by the Ministry of Trade. Current thresholds are published on the Ministry's official website.

14. Miscellaneous

14.1. Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in effect.

14.2. Assignment: QRbug may assign its rights and obligations under these Terms in connection with a merger, acquisition, or sale. You may not assign these Terms without our prior written consent.

14.3. Notices: Formal notices to QRbug shall be sent to [email protected] or to the postal address in Section 1. Notices to the User shall be sent to the email registered with the Account.

14.4. Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between the parties and supersede all prior oral or written representations.
